Terms of Service

The straightforward terms that govern buying hours and working with Awesome Factory.

01 Agreement

These Terms of Service ("Terms") govern your use of this website (the "Site") and the engineering services offered by Nicolas Perez, trading as Awesome Factory ("I", "me"). By using the Site or purchasing hours, you agree to these Terms. If you don't agree, please don't use the Site.

02 The services

Awesome Factory sells blocks of professional software-engineering time ("hours") at the rate published on the Site. Hours may be applied to development, integrations, reviews, consulting, and related engineering work as agreed between us. The specific scope and priorities for your hours are agreed at kickoff after purchase.

I provide services with reasonable skill and care, but the engagement is for engineering effort and time — not a guarantee of any specific commercial outcome.

03 Buying hours & payment

  • Prices are shown in the currency stated at checkout and are due in full at the time of purchase.
  • Payments are processed securely by Stripe. By purchasing, you also agree to Stripe's terms. I never receive or store your full card details.
  • You are responsible for any taxes that apply to your purchase unless stated otherwise.
  • Hours do not carry an artificial expiry, but I may agree a working window with you at kickoff to keep momentum.

04 Refunds & cancellation

Unused, unworked hours can be refunded on request. Once hours have been worked, that time is non-refundable. If we agree to end an engagement, you'll be billed only for hours already worked and any remaining prepaid, unworked balance is refunded. To request a refund, reach me through the contact form.

05 Your responsibilities

  • Provide timely access, information, and feedback needed to do the work.
  • Ensure you have the rights to any materials, code, or accounts you ask me to work with.
  • Use the services and the Site lawfully and not for any harmful or infringing purpose.

Delays caused by missing access or feedback may affect timelines and consume agreed hours.

06 Intellectual property

Unless we agree otherwise in writing, work product I create specifically for you and deliver as part of a paid engagement becomes yours once the corresponding hours are paid in full. I retain rights to my own pre-existing tools, libraries, and general know-how, and may reuse non-confidential, general-purpose components. The Site's own branding, copy, and design remain the property of Awesome Factory.

07 Confidentiality

I treat non-public information you share for the engagement as confidential and use it only to perform the services. Likewise, please keep any confidential materials I share with you private.

08 Warranties & liability

The Site and services are provided "as is" to the fullest extent permitted by law. To the maximum extent permitted by law, I am not liable for indirect, incidental, or consequential losses, and my total liability arising from an engagement is limited to the amount you paid for the hours giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

09 Third-party products

The Lab products (such as SoulDecode and Fusion Reports) may have their own separate terms that apply when you use them. These Terms cover the Awesome Factory Site and the purchase of engineering hours.

10 Changes & governing law

I may update these Terms from time to time; the "last updated" date reflects the current version, and your continued use of the Site means you accept the changes. These Terms are governed by the laws applicable at my place of business, and disputes will be handled by the competent courts there.
